Limnr AI - Terms of Service

PLEASE READ THIS TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE LIMNR AI PERSONALIZED AI-GENERATED PHOTO/IMAGE/VIDEO SERVICE ("SERVICE"), YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SERVICE.
1. Acceptance of Terms
By accessing or using the Limnr AI personalized AI-generated photo service (the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. User Accounts and Sign-Up
Account Creation: To use the Limnr AI Service, you must create an account either by signing up with your email address or by using Google Sign-In. By creating an account, you agree to provide accurate and complete information and to keep this information up to date.
Google Sign-In: If you choose to sign up or log in using Google Sign-In, you authorize Limnr AI to access email information from your Google account, in accordance with our Privacy Policy. Your use of Google Sign-In is also subject to Google's Terms of Service and Privacy Policy.
3. Description of Service
Limnr AI provides a credit-based personalized AI-generated photo service. Users can purchase AI credits to access and utilize various AI-generated photo customization features, subject to the terms outlined herein.
4. AI Credits and Payment
a. AI Credits: Users may purchase AI credits, which can be used to access the Service. AI credits do not expire and can be used at any time.
b. Payment: Payment for AI credits is processed through secure payment gateways. By purchasing AI credits, you agree to pay the specified fees associated with your selected credit package.
c. Billing Information: You are responsible for providing accurate billing and contact information. Failure to update such information may result in the inability to purchase AI credits.
d. Payment Processor: Limnr AI uses Stripe as its third-party payment processor. By purchasing AI credits, you agree to be bound by Stripe's Terms of Service, which can be found at Stripe's Terms of Service. Limnr AI is not responsible for any issues arising from the use of Stripe's services.
5. Intellectual Property
a. Third-Party AI Services: Limnr AI utilizes third-party services, including Replicate.com, for generating AI content. These third-party services retain ownership of their respective AI algorithms and/or platforms. By using the Service, you agree to comply with the terms and conditions of these third-party services, including but not limited to those provided by Replicate.com.
b. AI-Generated Content: Users are granted a non-exclusive, royalty-free license to use the AI-generated content for any purpose, including commercial and non-commercial uses. Limnr AI retains no ownership over the AI-generated content once delivered to the user.
c. Limnr AI Service: While Limnr AI does not own the AI algorithms and platforms used to generate content, it retains ownership of the overall service delivery and user experience provided to users.
d. User Content: User-provided content is only used for training AI models and not for any other purpose. Limnr AI does not use, modify, or reproduce user-provided content beyond this scope.
e. Prohibited Content: The generation of the following types of content is strictly prohibited:
  • Nudity, sexually explicit content, or any other form of adult content.
  • Content that is offensive, inappropriate, or violates community standards.
  • Illegal activities, including but not limited to content that violates intellectual property rights, privacy rights, or any other applicable laws.
6. Data Storage and Security
We use Cloudflare R2 for cloud storage of the data you upload or generate through the Service. By using the Service, you acknowledge and agree that your data may be stored on third-party servers managed by Cloudflare, subject to their terms and conditions.
7. Privacy
Limnr AI is committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and disclose personal information.
8. Termination
Limnr AI reserves the right to terminate or suspend your access to the Service at its discretion, with or without cause, including for breach of these Terms.
9. Disclaimer of Warranties
Limnr AI provides the Service on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Service for any particular purpose.
10. Limitation of Liability
Limnr AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Service.
11. Changes to Terms
Limnr AI reserves the right to update or modify these Terms at any time without prior notice. Users are encouraged to review the Terms periodically for changes.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
